This privacy policy outlines how information that identifies you personally is used so that you can make an informed choice about using this service. The terms of this policy apply to Media Equation Pty Ltd and its LookatmeDAM and Lookatmedia services ("Lookatme").
Privacy Principle 1: Open and transparent management of personal information
On behalf of a client, we may ask for your full name and email address, reason for using the service, or other information to register online, and in some cases other personally identifying information to fulfill licensing transactions or to receive products or services. Before you submit your registration we will ask your permission to access your personal information. Providing information on online forms is always voluntary, and you are free to decline from completing them. If you choose not to provide requested information some services may not be available to you. We may collect your IP address, navigational and purchase information. When you use the service, we place a text file called a cookie in the browser directory of your computer hard drive. A cookie is a small piece of information that a website can store on your web browser and retrieve later. The cookie cannot be read by any web site other than the one that set up the cookie. Cookies enable us to identify the information you have consented to provide and help us determine what portions of this service are most appropriate for your needs. Cookies give you the ability to retrieve previous search results and view your previous transactions. We will use the information only for the purpose of allowing you to use the service including processing your transactions, customer service, product and service development, direct marketing and marketing analysis, facilitating your use of this web site, and tailor your user experience to your particular interests. You can access and correct the information online 24 hours a day at the same website where information was submitted. You may deny the use of cookies but the Lookatme cookies are essential to the functioning of the web site and deleting or disabling them will reduce functionality. Site operators may engage third-party system such as Google Analytics to use cookies on our sites for the purpose of site analytics. This may allow the third-party system to collect information about your use of our site, which they may store in a country other than yours. If you do not want your information to be accessed by Google Analytics, you can install the Google Analytics opt-out browser add-on available at the Google Analytics opt-out page.
Privacy Principle 2: Anonymity and pseudonymity
You must identify yourself in order to use our service. It is impracticable and a security risk for us to deal with individuals who have not identified themselves or who have used a pseudonym.
Privacy Principle 3: Collection of solicited personal information
We will collect personal information only if the information is reasonably necessary for one or more of our functions or activities. We collect personal information about an individual only from the individual.
Privacy Principle 4: Dealing with unsolicited personal information
It is unlikely that we will receive unsolicited personal information. If we do, we will as soon as practicable but only if it is lawful and reasonable to do so, destroy the information or ensure that the information is de-identified.
Privacy Principle 5: Notification of the collection of personal information
Personal information is only collected by means of data submitted intentionally by the individual.
Privacy Principle 6: Use or disclosure of personal information
Personal information is collected only for the purpose of accessing the service. We will not use or disclose the information for another purpose unless we reasonably believe that the use or disclosure of the information is reasonably necessary for one or more enforcement related activities conducted by, or on behalf of, an enforcement body or to comply with legal process, respond to claims, or protect the rights, property or safety of our company, employees, customers, or the public.
Privacy Principle 7: Direct marketing
Purchasers of the service, the authorized personnel or administrators of those purchasers ("Administrators") and end-users who contact Lookatme directly can reasonably expect to have personal information collected used for direct marketing by Lookatme. End-users of the service can reasonably expect to have personal information collected used for direct marketing by the Lookatme client that administers the site. We are a contract service provider for government agencies and as such we may be required to use personal information for the purpose of meeting (directly or indirectly) an obligation under a given government contract. From time to time Lookatme may notify Administrators of special promotions, new products or services, or other information. The source of the personal information will be evident in each item of direct marketing. From time to time the site Administrator, being the Lookatme client that manages the site, may notify end-users of special promotions, new products or services, or other information in accordance with the privacy policies of the Administrator. You may request at no charge not to receive direct marketing by updating your user profile to 'opt out'. General email notifications related to your use of the service do not constitute direct marketing.
Privacy Principle 8: Cross-border disclosure of personal information
Cross-border disclosure of personal information is prevented by a privacy wall between Lookatme operations in Australia and other jurisdictions in which Lookatme operates. Personnel contracted by Lookatme in jurisdictions outside Australia including sales representatives and technicians do not have access to personal data on any Lookatme site controlled by an entity domiciled in Australia.
Entities domiciled outside of Australia may offer the Lookatme service to individuals in Australia; in this scenario the personal information collected is being provided by you to the overseas entity and you are expressly informed that Australian Privacy Principle 8 sub clause 1 does not apply; and, specifically, the information collected from a site of an entity domiciled outside of Australia may be stored, accessed, and used in jurisdictions whose privacy laws may be different and less protective than those of your home jurisdiction.
Privacy Principle 9: Adoption, use or disclosure of government related identifiers
We do not use government related identifiers except insofar as an email address may constitute a government related identifier and then only as reasonably necessary for the us to verify the identity of the individual for the purposes of our activities or functions.
Privacy Principle 10: Quality of personal information
We are committed to ensuring that personal information that we collect is accurate, up-to-date and complete by allowing you to access and update your information online 24 hours a day.
Privacy Principle 11: Security of personal information
We will take such steps as are reasonable in the circumstances to protect the information from misuse, interference and loss; and from unauthorized access, modification or disclosure. We consider that information provided by you to us is sensitive and deserves to be handled with the utmost care.
If we no longer need to use your personal information and it is not required by or under an Australian law, or a court/tribunal order, to retain the information we will take such steps as are reasonable in the circumstances to destroy the information or to ensure that the information is de-identified.
Privacy Principle 12: Access to personal information
Personal Information collected about you is available online to you 24 hours a day unless giving access would be unlawful; or denying access is required or authorised by or under an Australian law or a court/tribunal order; or we have reason to suspect unlawful activity; or giving access would be likely to prejudice one or more enforcement related activities.
Privacy Principle 13: Correction of personal information
Subject to constraints above personal information collected about you is available online to you 24 hours a day and can be corrected by you immediately.
Exclusions
This Privacy Policy does not apply to any Personal Data collected by Lookatme other than Personal Data collected through the Lookatme Services. This Privacy Policy shall not apply to any unsolicited information you provide to Lookatme through the Lookatme Services or through any other means. This includes without limitation information posted to any public areas of the Lookatme services, such as Lookatme Roadmap, any ideas for new or modified features and other unsolicited submissions (collectively, "Unsolicited Information"). All Unsolicited Information shall be deemed to be non-confidential and Lookatme shall be free to reproduce, use, disclose, and distribute such Unsolicited Information to others without limitation or attribution.
If you create a Lookatme Teambox, or you are invited to join a Lookatme Teambox and you accept the invitation, you agree that certain of your information will be shared with the team account holder and other team members. In particular, the team account holder will have access to your name, email address, avatar (if any) and task usage, and other team members will have access to your name, email address and avatar (if any). Any information you share via a Teambox will be available to all team members of the Teambox you have created or joined. You are solely responsible for any information you share via a Teambox, which is posted at your own risk.
Links to other Web Sites
This Privacy Policy applies only to the Services. The Services may contain links to other websites not under the control of Media Equation Pty Ltd (the "Third-Party Sites"). The policies and procedures we described here do not apply to the Third-Party Sites. Links from the Services do not imply that we endorse or have reviewed the Third-Party Sites. You should contact those sites directly for information on their privacy policies.
Security
Media Equation Pty Ltd takes reasonable measures to protect the Personal Data provided via the Services from loss, misuse, unauthorized access, disclosure, alteration, or loss. However, no internet or email transmission is completely secure or error-free. You should take special care in deciding what information you send to us via email. Please keep this in mind when disclosing any Personal Data to us. You should never disclose login credentials via email.
Changes to this Privacy Policy
The Services and our business operations may change from time to time and it may be necessary to make changes to this Privacy Policy. We reserve the right to modify this Privacy Policy at any time. If we do this, we will post the changes to this Privacy Policy on this page and will indicate the date these terms were last revised. In the case of material changes we will also notify you, either through the Service user interface, in an email notification or through other reasonable means. Please review this policy periodically, especially before you provide any Personal Data. Any changes will become effective 14 days after they are posted, except changes addressing new functions of the Service or changes made for legal reasons will be effective immediately. Your continued use of the Service after the date any such changes become effective constitutes your acceptance of such new Privacy Policy. This Privacy Policy was last updated on the date indicated below.
